You Need to do an Eviction?

Now that the 3 Day Notice has been served and the tenant has not paid and they are still in your house.  It’s time to start the eviction process. Deliver the 3 Day Notice

You always start with a 3 Day Notice.  The notice can be hand delivered, sent Certified Signature Requested, Return Receipt, and/or Regular letter.  There needs to be some type of verification, so we recommend that if you send a regular letter that you back that up with one or more of the other choices.

No Luck? Now File with the JP Court for a FED

So if the tenants do not respond then you must precceed to the local precinct and file a Forcible Entry and Detainer Law Suite (an Eviction) against the tenant(s).

The Constable will now notify the tenants that the eviction process has been started against them and a court date will be scheduled.  This process can take at least 10 days and sometimes longer.  If a holiday is approaching allow longer.

My advice is not to wait. I see way to often the landlord giving in to pleas and then never getting anymore rent, just more broken promises. I am sympathetic to someone in a bad position, but if you have a mortgage due, the banks are not so understanding.  Remember this is a business and not a charity.

Going to Court

Now the court date arrives and we go to court to get you the judgment for non-payment of rent. This is pretty much assured unless your paperwork is incomplete.  We need full disclosure in order to go to court for you.  Surprises in court are definitely not good.
